General terms and conditions of the marketplace of the Salzburger Christkndlmarkt association
The following General Terms and Conditions (GTC) apply to all transactions that customers make on our online platform. For reasons of better readability, we use the generic masculine spelling - of course this means all genders.

I. Conclusion of contract
The customer's order represents an offer to conclude a contract. A contract is only concluded after acceptance and subsequent notification by email from the Salzburger Christkindlmarkt Marktplatz.
During the ordering process, as well as before the order is finally sent, the customer receives supporting detailed information and the opportunity to correct their order. A successful order is only possible if all mandatory fields marked with “:” in the order form are filled out. If information is missing or the order cannot be fulfilled for other reasons, the customer will receive an error message. As soon as the ordering process is completed, the customer will be notified via the information window “Your order is completed and has been successfully shipped to us”. This does not constitute acceptance of the customer's offer by the Salzburger Christkindlmarkt Marktplatz.
The Salzburger Christkindlmarkt Marktplatz is not liable for incorrect information provided by customers of any kind, in particular delivery addresses, and any damage caused as a result. The costs incurred for repeated or impossible delivery must be borne by the customer and in this case the statutory provisions apply.
If the first delivery attempt is unsuccessful due to incorrect or incomplete delivery address information for which the customer is responsible, the Salzburger Christkindlmarkt Marktplatz will decide how to proceed after contacting the respective customer, depending on the individual case. Any impossibility of delivery will result in the destruction of the spoiled goods by the Salzburger Christkindlmarkt Marktplatz and the customer will be charged for this damage, including the shipping costs incurred.
Discount and voucher codes cannot be subsequently applied to orders.
The contract language is German.

II. Confirmation of receipt
When the order has been received, the customer will be notified of receipt of his order via the email address he provided. This understanding does not constitute acceptance of the customer's offer by the Salzburger Christkindlmarkt Marktplatz.

III. Contract storage
The purchase contract is stored by the Salzburger Christkindlmarkt marketplace, but is only accessible to customers via their web shop if they have created a customer account. The order confirmation received via email, including the contract text, can be printed out at any time after the order has been placed.

IV. Delivery Restrictions
The Salzburg Christmas market is aimed at Austria and Germany. The Salzburg Christkindlmarkt marketplace only delivers to delivery addresses within Austria and Germany.

V. Self-collection
At the moment, self-collection is not yet possible.

VI. clarification
The presentation of the goods in the online shop does not constitute a legally binding offer. It is merely a simple invitation to make an offer.

VII. Binding to the offer
The customer is bound to his order from the moment he receives it.

VIII. Receipt of the order
The day the order is received depends on the respective delivery conditions of the retailers/exhibitors.

IX. Prices and shipping costs
All prices are considered total prices. They include all taxes, including sales tax and duties as well as any shipping costs, unless these are stated separately.

The Salzburg Christmas market marketplace accepts the following payment methods:

XI. Due date and payment
The customer undertakes to pay the purchase price in full upon conclusion of the contract. In this case, the goods will only be delivered after the amount has been received into the bank account of the Salzburger Christkindlmarkt Marktplatz.

XII. Retention of title
Until full payment has been made, the delivered goods remain the property of the Salzburger Christkindlmarkt Marktplatz.

XIII. Transport damage
If goods are delivered with obvious transport damage, the customer must inform the deliverer of this as soon as possible and contact the Salzburger Christkindlmarkt Marktplatz. Customers’ statutory warranty rights remain unaffected by this.

XIV. Right of withdrawal
Consumers within the meaning of the Consumer Protection Act (KSchG) have the right to cancel the purchase contract within 14 days of receipt of the goods without giving reasons. In this case, depending on the payment method previously chosen, customers will receive a refund for payments already made, including any delivery costs for the first shipment from the Salzburg Christkindlmarkt Marktplatz, within 14 days of receipt of the cancellation; The costs for return shipping must be borne by the customers. The Salzburger Christkindlmarkt Marktplatz reserves the right to withhold refunds until the goods affected by the cancellation arrive. There is no right of withdrawal for goods that perish quickly or for goods whose expiry date would quickly be exceeded; For goods that are delivered sealed and are not suitable for return for health protection or hygiene reasons, the right of withdrawal does not apply if they have been unsealed after delivery.

XV. guarantee
The Salzburg Christkindlmarkt marketplace guarantees the delivery of defect-free goods. If individual goods in an order do not meet these requirements or the customer's expectations, the customer has the opportunity to notify the Salzburger Christkindlmarkt marketplace immediately after receiving the order. The customer will then be refunded the money, depending on the payment method previously chosen, in the amount of the price of the goods in question.

XVI. Special features when purchasing via the Salzburg Christkindlmarkt market place
When making purchases via the Salzburger Christkindlmarkt Marktplatz, the Salzburger Christkindlmarkt Association only acts as an intermediary; the contractual partner of the customer is the respective exhibitor, whose contact details the Salzburger Christkindlmarkt Marktplatz makes available to the customer following an order. The handover or shipping of the goods will be agreed directly with the exhibitor; their terms and conditions apply.

Consumers have the option to contact the EU's online dispute resolution platform: https://ec.europa.eu/odr.

Austrian substantive law applies to this contractual relationship, excluding the UN Convention on Contracts for the International Sale of Goods. For business-related transactions on both sides, the place of jurisdiction is agreed to be the court with material and local jurisdiction for the location of the Salzburger Christkindlmarkt Marktplatz, provided that legal provisions do not conflict with this.
